These Terms of Service ("Terms") govern your access to and use of the websites, applications, software, tools, data, workflows, integrations, and services provided by the program*, doing business as Card Pairer ("Card Pairer," "we," "us," or "our").
By accessing or using Card Pairer, creating an account, uploading content, connecting an integration, purchasing a subscription or credits, or clicking to accept these Terms, you agree to be bound by these Terms. If you do not agree, do not use Card Pairer.
Use of Card Pairer
Card Pairer provides tools for trading-card capture, matching, catalog lookup, image processing, title generation, listing preparation, workflow automation, and related services. The service is intended for current and prospective customers, including card shops, consignors, breakers, dealers, platforms, and collectors.
You may use Card Pairer only for lawful purposes and in accordance with these Terms. You are responsible for your account, your users, your submitted content, your connected integrations, and your use of the service.
Accounts
You must provide accurate account information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at support@cardpairer.com if you believe your account has been compromised.
We may require account verification, including email, phone, business, or payment verification, before enabling certain features.
Prohibited Conduct
You may not use Card Pairer to:
- Violate any law, regulation, marketplace policy, or third-party right.
- Upload, transmit, or display unlawful, defamatory, harassing, obscene, deceptive, threatening, or abusive content.
- Submit content that infringes copyrights, trademarks, publicity rights, privacy rights, or other proprietary rights.
- Upload private information about another person without permission.
- Send spam, fraudulent offers, misleading listings, malware, or unauthorized solicitations.
- Interfere with, disrupt, reverse engineer, scrape, overload, or attempt to gain unauthorized access to Card Pairer or its systems.
- Use automated tools to access Card Pairer except through APIs or features we expressly provide.
- Misrepresent card details, condition, authenticity, ownership, grade, serial numbering, or listing information.
- Use Card Pairer to facilitate counterfeit, stolen, fraudulent, or otherwise unlawful transactions.
We may remove content, restrict features, suspend accounts, or terminate access if we believe these Terms have been violated.
User Content and Card Data
"User Content" includes card images, scans, titles, descriptions, listing drafts, card attributes, catalog corrections, pricing inputs, marketplace data, comments, feedback, and other materials submitted to Card Pairer.
You retain ownership of your User Content. By submitting User Content, you grant Card Pairer a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, transmit, analyze, modify, and use that content as needed to provide, secure, support, and improve the service, including matching, title generation, catalog improvement, automation, support, analytics, and connected integrations.
You represent that you have all rights and permissions necessary to submit User Content and grant this license.
Card Matching, Recognition, and Catalog Data
Card Pairer may use software, data, automation, computer vision, machine learning, third-party sources, and human review to identify cards, suggest matches, generate titles, and prepare listing information.
Card Pairer is designed to improve speed and accuracy, but recognition, catalog, checklist, title, pricing, and listing outputs may be incomplete, incorrect, outdated, or unsuitable for a specific transaction. You are responsible for reviewing outputs before publishing listings, selling cards, shipping items, or making business decisions.
We may update, correct, remove, or change catalog data, recognition models, matching logic, title templates, and workflow features at any time.
Integrations and Third-Party Services
Card Pairer may connect with third-party services such as marketplaces, scanners, payment processors, shipping providers, authentication providers, analytics tools, or communication services. Your use of those services is governed by their terms and privacy policies.
We are not responsible for third-party services, marketplace decisions, account restrictions, outages, fees, errors, data practices, or transaction outcomes.
Payments, Subscriptions, and Credits
Fees, subscriptions, usage charges, credits, and billing terms will be disclosed at purchase or in an applicable order form.
Unless otherwise stated in writing:
- Fees are due when charged.
- Subscriptions renew automatically until canceled.
- Credits have no cash value and are not transferable.
- Promotional or free credits may expire or reset according to the offer terms.
- We may change pricing, packages, features, or credit rules prospectively.
- Refunds are provided only as required by law or as expressly stated in the applicable order form or refund policy.
If payment fails or amounts are overdue, we may suspend or limit access to paid features.
Complaints and Content Review
If you believe content or activity on Card Pairer violates these Terms, infringes your rights, or is otherwise improper, contact support@cardpairer.com with enough detail for us to review the issue, including the content location, account or listing information, and the reason for your complaint.
We may review complaints, remove or restrict content, suspend accounts, notify affected users, and provide an opportunity to respond when appropriate.
Ownership of Card Pairer
Card Pairer and its software, designs, workflows, interfaces, text, graphics, logos, databases, catalog structures, templates, models, algorithms, and other materials are owned by Card Pairer or its licensors and are protected by intellectual-property and other laws.
Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from Card Pairer or its materials.
Feedback
If you submit ideas, suggestions, corrections, or feedback, you grant Card Pairer the right to use them without restriction or compensation.
Privacy
Our Privacy Policy explains how we collect, use, and share information. By using Card Pairer, you agree that we may process information as described in the Privacy Policy.
Copyright and DMCA
If you believe material on Card Pairer infringes your copyright, send a notice to support@cardpairer.com with the information required by the Digital Millennium Copyright Act. We may remove allegedly infringing material and may terminate accounts of repeat infringers where appropriate.
Disclaimer of Warranties
Card Pairer is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, availability, reliability, and security.
We do not warrant that Card Pairer will be uninterrupted, error-free, secure, accurate, or suitable for any particular card, listing, marketplace, sale, or business outcome.
Limitation of Liability
To the fullest extent permitted by law, the program*, Card Pairer, and their affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, marketplace penalties, listing errors, transaction losses, or card valuation decisions.
To the fullest extent permitted by law, our total liability for any claim relating to Card Pairer will not exceed the amount you paid to Card Pairer for the service giving rise to the claim during the twelve months before the claim arose, or $100, whichever is greater.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless the program*, Card Pairer, and their affiliates, officers, employees, agents, licensors, and service providers from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of Card Pairer, your User Content, your listings or transactions, your violation of these Terms, your violation of law, or your violation of third-party rights.
Termination
You may stop using Card Pairer at any time. We may suspend, restrict, or terminate your access at any time if we believe you violated these Terms, created risk or liability, failed to pay amounts owed, misused the service, or if continued access would harm Card Pairer, users, partners, or third parties.
Upon termination, your right to use Card Pairer ends. Sections that by their nature should survive termination will survive, including ownership, User Content licenses, payment obligations, disclaimers, limitations of liability, indemnification, dispute provisions, and general terms.
Third-Party Links
Card Pairer may link to third-party websites or services. We do not control and are not responsible for third-party content, accuracy, policies, products, services, or security. You access third-party links at your own risk.
Governing Law and Venue
These Terms are governed by applicable law, without regard to conflict-of-law rules. Disputes relating to these Terms or Card Pairer will be handled in a court with proper jurisdiction, unless applicable law requires otherwise.
Claim Limitation
To the fullest extent permitted by law, any claim relating to Card Pairer or these Terms must be filed within one year after the claim arose, or it will be permanently barred.
Changes to Card Pairer or These Terms
We may modify Card Pairer, including features, workflows, integrations, pricing, catalog coverage, and availability, at any time.
We may update these Terms from time to time. Updated Terms become effective when posted or when otherwise communicated, unless a later effective date is stated. Your continued use of Card Pairer after updates become effective means you accept the updated Terms.
Electronic Communications and Signatures
You agree to receive communications electronically, including notices, agreements, disclosures, security alerts, support messages, and administrative communications. Your electronic acceptance, click, checkbox, typed name, or other electronic action may have the same legal effect as a handwritten signature.
Entire Agreement
These Terms, the Privacy Policy, and any applicable order form, product-specific terms, or policies referenced here make up the entire agreement between you and Card Pairer regarding the service and replace prior or contemporaneous agreements about the same subject.
If any provision is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver.
